How Out-of-State DUI Convictions Reach Georgia

Georgia's Department of Driver Services does not receive automatic conviction reports from DLC-member states, but it does participate in AAMVA's Problem Driver Pointer System and the National Driver Register. When you renew your Georgia license, DDS queries these databases to check for out-of-state suspensions, revocations, and serious convictions. A Florida DUI conviction, a South Carolina DWI suspension, or an Alabama ignition interlock requirement will appear in these queries even though Georgia is not a DLC member.

If the out-of-state state has suspended your driving privilege in that state, Georgia typically will not issue or renew your Georgia license until the out-of-state suspension is resolved. This is not DLC reciprocity—it is Georgia's own policy under O.C.G.A. Title 40, Chapter 5, which requires Georgia DDS to verify that an applicant does not hold a suspended or revoked license in another jurisdiction. For commercial drivers, CDLIS reports all disqualifying offenses federally, including out-of-state DUIs, regardless of DLC membership. If the out-of-state state did not suspend your license—for example, you paid the fine, completed probation, and retained driving privileges in that state—the conviction may still appear in the AAMVA query, but Georgia typically will not block renewal unless the out-of-state state shows an active suspension or revocation. Georgia does not impose home-state suspension for out-of-state DUI convictions the way DLC-member states do. The structural difference is meaningful: you avoid automatic suspension in Georgia, but you cannot avoid the renewal block if the out-of-state suspension remains unresolved.

Interstate Move Triggers Cross-State Checks

SR-22 Filing and Cross-State Insurance Requirements

If the out-of-state state requires SR-22 proof of insurance as a condition of reinstatement after the DUI conviction, you must file SR-22 with that state's DMV even though you hold a Georgia license. Most states accept SR-22 filed by carriers licensed in the state where the violation occurred, regardless of where the driver currently resides. You purchase an SR-22 policy from a carrier licensed in the suspending state, and the carrier files the SR-22 certificate with that state's DMV electronically.

Georgia does not require SR-22 for most DUI convictions unless the conviction occurred in Georgia. If your DUI occurred in Florida and Florida requires FR-44 filing, you must file FR-44 with the Florida DMV to lift the Florida suspension. Georgia DDS does not require you to file SR-22 or FR-44 in Georgia for the Florida conviction. The filing requirement is tied to the suspending state, not your state of residence.

If the out-of-state state suspended your driving privilege and requires SR-22 filing to lift the suspension, complete the out-of-state reinstatement process before your Georgia license expires.
